1. Application Publisher

The mobile application KCalories (hereinafter “the Application”) is published by:

In accordance with article 6-III-2 of the LCEN, the Publisher, as a natural person publishing on a non-professional basis, is exempt from disclosing its complete identity on the online services it operates. The Publisher’s complete identity (name and address) is communicated to the hosting provider as required by law and kept available to any competent judicial authority, but is not published in the present document.

2. Publication Director

The publication director is the Publisher of KCalories, a natural person publishing on a non-professional basis (identity communicated to the hosting provider, see section 1).

For any request addressed to the publication director, you may use the contact details indicated in section 1.

4.1 Open Food Facts

The Application uses the open Open Food Facts database for food searches by barcode and by name.

The Publisher does not warrant the accuracy or exhaustiveness of data sourced from Open Food Facts. In the event of an error on a food entry, the User is invited to report the error directly on Open Food Facts.

4.2 CIQUAL tables (ANSES)

The Application integrates CIQUAL nutritional reference data published by the French Agency for Food, Environmental and Occupational Health Safety (ANSES):

4.3 USDA FoodData Central

The Application also uses the FoodData Central nutritional database published by the United States Department of Agriculture:

5. Intellectual Property

5.1 Application and KCalories trademark

The Application, its source code, design, graphical interfaces, original texts, proprietary databases, logo, KCalories trademark and all elements composing it are the exclusive property of the Publisher, protected by French and international intellectual property law (French Intellectual Property Code, articles L111-1 et seq.).

Any reproduction, representation, modification, publication, full or partial adaptation of the Application, by any process whatsoever, without the prior written authorisation of the Publisher, is strictly prohibited and constitutes an act of counterfeiting sanctioned by articles L335-2 et seq. of the French Intellectual Property Code.

5.2 Third-party trademarks cited

The trademarks cited in the Application remain the property of their respective holders:

• Apple, App Store, iOS, iPhone, iPad, HealthKit: trademarks of Apple Inc.
• Firebase, Google Cloud: trademarks of Google LLC.
• Vercel: trademark of Vercel Inc.
• Open Food Facts: trademark of the Open Food Facts association.

6. Third-party and open source libraries

The Application integrates open source libraries. The exhaustive list and associated licences are available in the dedicated section of the Application’s Settings (Settings → About → Third-party libraries) or available on request from the Publisher.

7. Personal data

The processing of personal data by the Application is governed by the Privacy Policy accessible from Settings → Legal → Privacy Policy.

The Publisher acts as data controller within the meaning of Regulation (EU) 2016/679 (“GDPR”). At this stage, the Publisher is not required to appoint a Data Protection Officer (DPO). Any change to this obligation will be reflected in an update of the Privacy Policy.

To exercise a GDPR right, the User can contact the Publisher at contact@kcaloriesapp.com.

The User also has the right to lodge a complaint with the competent supervisory authority:

8. Cookies and tracers

The Application does not use cookies within the meaning of the ePrivacy Directive 2002/58/EC, being a native iOS application.

The Application nevertheless uses certain technical identifiers necessary for its operation:

• AppCheck token (Firebase): security, fraud prevention (legitimate interest, GDPR art. 6-1-f);
• FCM token: sending push notifications if enabled by the User (consent, GDPR art. 6-1-a);
• Anonymised crash reports (Crashlytics): stability improvement (legitimate interest, GDPR art. 6-1-f).

11. Reporting of illegal content

In accordance with article 6-I-5 of the LCEN, any reporting of manifestly illegal content hosted through the Application may be addressed to the Publisher by email at contact@kcaloriesapp.com specifying:

• The identity of the reporter (last name, first name, address);
• The precise description of the contentious content and its location in the Application;
• The reasons for which the content must be withdrawn;
• A copy of correspondence sent to the author or publisher of the content requesting its withdrawal, where applicable.

The Publisher undertakes to examine any notification as soon as possible and to withdraw or render inaccessible any manifestly illegal content of which he becomes effectively aware.
